Amends to Act 427-2000, "Act to Regulate the Period to Breastfeed or to Express Breast Milk”

What are the changes to Law 427-2000?

A new Article 10 was added to Act 427-2000 to prohibit the use of the breastfeeding period as a basis for:

  • giving unfavorable evaluations
  • taking adverse or detrimental actions,
  • efficiency criteria in performance reviews
  • justifying disciplinary actions
  • discrimination

In addition, Article 10 of Act 427-2000 now includes a non-exhaustive list of actions that may be considered "detrimental." Among these are:

  • reduction of work hours
  • job reclassification
  • shift changes
  • requiring the employee to make up the time used for breastfeeding or expressing breast milk

Finally, Article 11 was added to Law 427-2000, requiring that the law be interpreted in the manner most favorable to the nursing mother.
